In the following we would therefore like to inform you in detail about which personal data is collected during your visit to our website and the use of our offers there and how this personal data is processed by us. 2. Name and address of the data controller and service provider

3. Collection and use of your personal data
The extent, type and use of your personal data will differ depending on whether you visit our website only to access information, or use services offered by us or log into a protected area for health care professionals (HCP). 

Where we process your personal data under the legal basis of legitimate interests, we make sure we consider and balance any potential impact on you and your rights before we process your personal data for our legitimate interests. You can obtain further information about how we assess our legitimate interests against any potential impact on you by contacting us under the details provided in section 2 above. 

Where we need to collect your personal data by law, or under the terms of a contract we have with you or to enter into a contract with you, failure to provide the relevant personal data may mean that we are not able to perform the contract we have or are trying to enter into with you, and we may have to cancel a product or service you have with us.

a. Informational use
For the informational use of our website it is generally not necessary for you to provide personal data.
Rather, in this case we collect and use only those of your data that your internet browser automatically transmits to us. These are in particular the following:
- Date and time of access to one of our internet pages
- Your browser type
- The last page you visited
- The transferred data volume and the access status (file transferred, file not found, etc.) 
- Your IP address.
The data is stored in log files on our server for 12 months. Except for the IP address, we only process this data in an aggregated form during an informational visit. We process your personal data in order to enable you to access and use the website and to be able to check whether our websites are optimally displayed to you. The processing is carried out under the legal basis of legitimate interests. It is in our interest to be able to display our website to you reliably and as trouble-free as possible. The data arising during the informational use including your IP address are stored in order to ensure the operation of the website and to be able to react to problems. A personal evaluation of the data does not take place. Only statistical evaluations of the use of the website are made, as described further below in this policy.

If you would like to contact us via our contact form, we will collect the information that you provide when completing the form, including any personal data contained in the following:

We use personal data to forward your inquiry to the department responsible at Daiichi Sankyo and to be able to answer it by e-mail or, if necessary, by telephone, post or fax. In addition, we can use your details to personalize our response and provide you with specific information for your business.
We process the captcha request to verify that it is a real request and not a "login robot" or automated spam requests. Your entry there will only be used for this check and will not be stored.
If your inquiry relates to an existing contractual relationship between us or if you are interested in concluding a contract, e.g. with regard to a consultant activity, the data processing is carried out under the legal basis of processing necessary for the performance of a contract.
Otherwise, the data will be processed under the legal basis of  legitimate interests. It is in our interest to be able to answer your inquiry with the information relevant to you by our internal department. The data processing of the captcha query is in our interest in order to prevent automated logins via logon robots or spam requests. We store the personal data collected via the contact form for as long as is necessary for processing and answering the respective inquiry.

c. Login to the non-public area
We may also offer registered users the opportunity to log in to the non-public area. This is reserved for members of medical circles (HCP).
The processing of your personal data on our website for registration in the non-public sector is based on the legal basis of processing necessary for compliance with a legal obligation to which we are subject, in connection with our obligation to verify that only members of medical professionals have access to information on prescription products.

The personal data collected is stored for as long as is necessary for us to comply with our legal obligations under applicable laws.
 
d. Data processing of reports of adverse reactions
If you contact a Daiichi Sankyo national subsidiary to report an adverse reaction, you can do so anonymously, i.e. without your name or other identifier, or you can provide your personal data. You will find the name and contact details for the relevant Daiichi Sankyo national subsidiary as well as contact details for the Data Protection Officer under section 2.
If your report includes personal data, we will store the personal data you provide for up to 10 years after the expiration of the marketing authorisation for the medicine to which the adverse reaction report relates. In addition to the report of the adverse reaction itself, we generally store your name, address and contact data as well as the date and time of the report. The purpose is to receive reports of adverse reactions in accordance with the prescribed rules and to be able to contact you with questions. Such data processing enables us to comply with our legal obligations and is necessary for reasons of public interest in the area of public health.
This personal data is not transferred to a different location until anonymised. The Pharmacovigilance Department of the respective national subsidiary processes the report internally and anonymises the data before forwarding it to a global database.
If the report is made anonymously, the national subsidiary does not collect or process any personal data relating to you. In other respects, the report of an adverse reaction will be processed and stored / deleted in accordance with the aforementioned procedure.

e. Data processing in case of medical enquiries
If you contact Daiichi Sankyo to enquire about product information in the medical field, Daiichi Sankyo stores the personal data which you provided at the time of contact. To ensure we are dealing with an HCP, this data includes your name, professional details and contact data as well as the date and time of this contact. The purpose of this processing is to be able to respond to your medical enquiry, and so your personal will be stored for as long as is necessary for processing and answering the respective inquiry.
You will find the name and contact details for the relevant Daiichi Sankyo national subsidiary as well as contact details for the Data Protection Officer under section 2.
The legal basis for such data processing is for our legitimate interests. It is in our interest to ensure we are communicating with an HCP, and to provide you with information on products which you have enquired about.  

4. Use of Cookies
a. Which cookies do we use?
We use the technology of cookies for our internet presence. Cookies are small text files that are sent from our web server to your browser during your visit to our website and are stored on your computer, tablet computer or smartphone for later retrieval.

- [_ga] Function: This cookie is part of Google Analytics and is used for statistical analysis of user behavior on our websites. It contains an individual Google Analytics identification number and is stored for 2 years. The cookie is a so-called first-party cookie which is controlled from our website.
- [_gid] Function: This cookie is part of Google Analytics and is used for statistical analysis of user behavior on our websites. It contains an individual Google Analytics identification number and is stored for 24 hours. The cookie is a so-called first-party cookie which is controlled from our website.

8. YouTube Videos
We use videos and plug-ins from YouTube on our website. YouTube is a service provided by YouTube LLC (901 Cherry Ave., San Bruno, CA 94066, USA; "YouTube"). YouTube LLC is a subsidiary of Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; "Google).
We use the so-called "extended data protection mode" of YouTube. This means that when you visit our website, only a picture (so-called "thumbnail") of the embedded video is called up by YouTube or Google and only the data mentioned in Section 3 a) of this policy are transmitted to YouTube or Google.
Only when you call up the video with a click, further data is transmitted to YouTube or Google and cookies are set by these third-party providers. If you are logged in to a YouTube or Google account, additional data can be assigned directly to your account via the video call, depending on your account settings. The processing of your data is carried out under the legal basis of our legitimate interests. It is in our interest to be able to make the videos available to you on our website and at the same time to relieve our servers.

9. Sharing of your personal data 
a. External 
Your personal data will be passed on to technical service providers supporting us (i.e. internal and external website hosting and support) for the provision of this website and for the aforementioned purposes. 
These service providers are bound by our instructions and are regularly checked by us.
Otherwise, your data will only be passed on to other third parties if expressly stated in this policy or if we are legally obliged to do so.

b. Internal
We may share anonymised data with other members of the Daiichi Sankyo group (see list of Daiichi Sankyo national subsidiaries here) for the purposes of adverse reactions reports.

The external and internal third parties may be located in, or use technology, equipment, products and services located in, countries outside of the EU and the UK that are not regarded as providing the same level of protection for personal data as that under the GDPR. Where this is the case, we will ensure that appropriate safeguards such as Standard Contractual Clauses, as approved by the European Commission or the UK Government, are in place in accordance with applicable legal requirements to provide adequate protections for your personal data. You may contact us using the details above to obtain information regarding the safeguards we use to transfer personal data outside of the EU and the UK.

10. Referral to external websites and services
We have integrated various third-party services into our websites, such as registration for our protected area via DocCheck.com or services relating to the congress calendar. In these cases you technically leave our websites and enter the websites of the respective third party provider. In such cases, the respective third party provider alone is responsible for the processing of any personal data. If you have any questions in such cases, please contact the third party provider directly. As far as we refer you by link to the websites of third parties, this also applies. We use such links, for example, on the various social networks; we do not use so-called social media plug-ins for data protection reasons.
In both cases we would like to point out that a certain area of our website is offered by a third party or is passed on to such a third party.

11. Your rights
You have the right to request confirmation from us whether personal data relating to you is processed; if this is the case, you have a right of access to this personal data and the information specified in Art. 15 GDPR.
You have the right to request us to correct any incorrect personal data concerning you and, if necessary, to complete incomplete personal data without delay (Art. 16 GDPR).
You have the right to request us to delete personal data relating to you in certain circumstances, e.g. if the data is no longer required for the purposes pursued (Art. 17 GDPR).
You have the right to request us to restrict processing in certain circumstances, e.g. if you have filed an objection to the processing, for the duration of our examination (Art. 18 GDPR).
You have the right to object at any time for reasons arising from your particular situation to the processing of personal data concerning you, which is carried out under the legal basis of legitimate interests. We will then no longer process the personal data unless we can prove compelling reasons for the continued processing that outweigh your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims (Art. 21 GDPR).
Where you have provided consent to our processing of your personal data, you have the right to revoke your consent to us at any time with effect for the future (Art. 7.3 GDPR).
You have the right to receive from us the personal data concerning you that you have provided to us in a structured, common and machine-readable format. You can also transfer this data to other locations or have it transferred by us, in certain circumstances (Art. 20 GDPR).

12. Data security
We also use technical and organizational security measures to protect personal data that is collected, in particular against accidental or intentional manipulation, loss, destruction or against the attack of unauthorized persons. Our security measures are continuously improved in line with technological developments.
